Penn & Seaborn has recently filed a product liability lawsuit on behalf of our clients in which the plaintiff was severely injured in an accident involving a Tigercat log skidder. The complaint was filed in the Circuit Court of Barbour County, Alabama (Clayton Division) (CV-2013-900043) against Tigercat Industries Corporation.

The complaint charges Tigercat with designing, manufacturing and distributing a defective product that was sold in an unreasonably dangerous condition. There are additional claims of breach of warranty, negligence and wantonness. The lawsuit alleges that Tigercat placed a dangerous product into the stream of commerce and knew or should have known the product was unreasonably dangerous.
