Lawsuit filed on behalf of Montgomery man killed in construction accident

The family of a Montgomery man killed in a construction accident at the Montgomery Outer Loop Project on Wednesday has filed a wrongful death lawsuit against the company.

Myron Penn of Penn & Seaborn filed the suit on behalf of David Lee and Shania Renee Mahone, children of victim David Lee White, in Montgomery County today. The defendants are listed as the R.R. Dawson Bridge Co. and Miller Formless Systems.

White, 63, along with Lomax Phillips, of Birmingham were working on a bridge in a piece of equipment about 90 feet from the ground, when the equipment failed and fell to the ground, killing the men, according to the lawsuit and law enforcement.

The suit claims that the wagon lift was defective, which caused it to fall.

Both men, who were said to have worked for R.R. Dawson Bridge Co. for several years, were pronounced dead on the scene Wednesday morning.

The Montgomery County Sheriff’s Office, the Alabama Department of Transportation and the Occupational Safety & Health Administration (OSHA) are investigating.

Work on the Outer Loop Project has been temporarily suspended, ALDOT, released. R.R. Dawson Bridge Co. of Bessemer is the prime contractor for ALDOT’s Outer Loop Project.
